These Terms and Conditions govern sales concluded by DLG Racing with consumer customers, notably for the design and supply of made-to-measure and/or customized Supermoto suits.
Sales contact and complaints: contact@dlgracing.com. The applicable Terms are those accepted at the time of the order.
2. PRODUCTS & CUSTOMIZATION
DLG Racing offers made-to-measure and customizable Supermoto suits. Depending on the project, the customer may notably choose leather, colors, logos, name, number, graphic elements and certain technical options.
Photos and renderings are presented carefully, but slight differences in shade, texture or placement may occur due to materials, screens and technical production constraints.
3. PROJECT, ORDER & APPROVAL
Submitting the “Start my project” form is a contact request and does not by itself constitute a binding order. The order becomes binding when the essential project specifications, price and payment terms have been communicated and accepted by the customer.
The customer must carefully check the information and customization details supplied. When an approval mock-up or visual is submitted, approval authorizes production on that basis.
4. MEASUREMENTS & CUSTOMER RESPONSIBILITY
DLG Racing guides the customer through taking measurements. The customer nevertheless remains responsible for the accuracy of measurements and information supplied and agrees to follow the instructions provided.
If measurements are inconsistent or incomplete, DLG Racing may request new measurements or information before production. Production time starts only once the file required for production is complete and approved.
Where measurements supplied in accordance with DLG Racing's instructions are correct but the final fit presents an issue attributable to production, DLG Racing carries out the necessary corrections at no extra cost to the customer. This applies without prejudice to the statutory legal guarantee of conformity.
5. PRICE & PAYMENT
Current configuration prices are as follows: 1.3 mm cowhide, €620 semi-custom and €690 100% custom; 1.1 mm kangaroo leather, €920 semi-custom and €990 100% custom. Any options or special requests involving an additional charge are communicated before the order is approved.
The total order amount is payable 100% before production starts. Production begins only after full payment has been received and all necessary project elements, including measurements and, where applicable, design, have been approved.
6. PRODUCTION & DELIVERY
The usual stated production lead time is 4 to 6 weeks from the time the project is complete, approved and ready for production. This lead time may be adjusted when a particular circumstance is clearly communicated to the customer.
A delay caused by missing or late transmission of information, measurements, logos or approvals required for the project will accordingly postpone the start or continuation of production.
Delivery is included in the price for addresses in Belgium, France, Germany, the Netherlands and Luxembourg. For any other destination, availability and any delivery charges are provided on request and before order approval.
7. RIGHT OF WITHDRAWAL
DLG Racing suits made to the customer's measurements and/or clearly customized according to their choices are goods made to the consumer's specifications or clearly personalized. Under applicable law, the 14-day right of withdrawal does not apply to such customized or made-to-measure goods.
This exclusion of the withdrawal right does not remove the consumer's rights in the event of a lack of conformity.
8. RECEIPT & CONFORMITY
The customer is invited to inspect the package and product upon receipt. In the event of visible damage or anomaly, the customer should keep photographs and promptly contact DLG Racing at contact@dlgracing.com.
If the product does not match the approved project or has a lack of conformity, DLG Racing will assess the request under the applicable legal guarantee and the project records.
9. LEGAL GUARANTEE OF CONFORMITY
For consumer sales, new goods benefit from the statutory legal guarantee of conformity. In Belgium, this generally covers lack of conformity identified within two years from delivery of the goods.
The legal guarantee is not intended to cover normal wear, damage caused by a crash or accident, misuse, improper care, unauthorized modification, or a fit issue directly caused by incorrect measurements supplied by the customer. These exclusions apply without prejudice to mandatory consumer rights where the defect is attributable to the seller.
10. LOGOS, GRAPHICS & INTELLECTUAL PROPERTY
A customer supplying a logo, trademark, image, name or other element for customization guarantees that they have the necessary rights or permissions to request its use.
DLG Racing's own creative elements, including logos, visuals, mock-ups, graphics and content, remain protected by applicable intellectual property rights unless otherwise agreed in writing.
11. COMPLAINTS, MEDIATION & APPLICABLE LAW
Any complaint should first be addressed to DLG Racing at contact@dlgracing.com, with information allowing the project to be identified and, where necessary, photographs of the issue.
Where competent, a consumer may then use the Belgian Consumer Mediation Service to seek an amicable resolution. Mediation does not deprive either party of the right to bring the matter before the competent courts.
These Terms are governed by Belgian law, without depriving the consumer of any more protective mandatory provisions applicable under the law of their country of residence.
